Marriages Performed in Jails
Are you looking to marry your loved one that is incarcerated? If you answered Yes, we can help you with the process. The first step you are going to need a "Inability to Appear" package which must be obtained from the County Recorders office. I can also provide the package that you will need also. I can fax or e-mail the form to you.
Our notaries are available during the hours of the detention centers to notarize the "Affidavit of the Inability to Appear". The notary will have the incarcerated person sign the form and marriage license. Before the County Recorder will issue a marriage license they will require 3 ID's. This would include identifications from the bride, groom and the officiant who will be performing the wedding ceremony. (See above for all the acceptable ID's that are allowed).
After the notarization, the bride or groom, and the officiant must appear together at the County Recorder with all 3 valid identifications and the "Inability to appear" form. The marriage license is then processed and then the fee is paid and the marriage license is issued the same day as long as we are there 2 hours before closing. Then you can now choose the date and follow the instructions of that particular detention center. You will then notify the officiant of the date and time for your wedding ceremony. The wedding ceremony will take place during the normal visiting hours and will be performed through the glass.
After the ceremony. the officiant will complete the wedding license and file it with the County Recorders Office. After the filing of your marriage license or Certificate, a certified copy of your marriage license can be obtained after 6-8 weeks of the filing. Expedited service of your license or certificate is available through Express mail. The request must be made at the same time the marriage or certificate is being turned into the County Recorder by the officiant.
Prices start at $600. There is a $100 non-refundable deposit required at the time we meet at the County Recorder Office. The Notary that handles the "Inability to Appear" form will require $200 to go into the detention center. The balance of the fee must be paid a few days before the ceremony takes place.
